The global game of digital trade rules
As the proportion of the digital economy in global GDP continues to rise, the formulation of digital trade rules has become one of the most important and controversial issues in international economic and trade governance. All major economies and international organizations are actively promoting the negotiation and formulation of digital trade rules, but there are still significant differences in positions on core issues.
Novaris Business Development Society has sorted out several core issues and latest developments in the field of current global digital trade rules:
- Cross-border data flows:This is the most controversial issue in digital trade rules. The United States advocates the free flow of data, the European Union emphasizes the priority of personal data protection, while many developing countries focus on data sovereignty and localized storage. How to find a balance between data flow and data protection is still the focus of the game between all parties.
- Digital services tax:The issue of tax allocation for multinational digital enterprises has triggered extensive international discussions. The global minimum tax framework and profit redistribution plan promoted by the OECD have made phased progress, but there are still differences in implementation details.
- E-commerce tariffs:The WTO's temporary ban on electronic transmissions being exempted from tariffs has been extended multiple times, but calls from developing countries to impose tariffs on digital products are growing.

The e-commerce chapter in RCEP also provides an institutional foundation for digital trade cooperation in the Asia-Pacific region.
The Institute believes that global unification of digital trade rules will be difficult to achieve in the short term, but regional and bilateral rules frameworks will continue to advance rapidly. It is critical for businesses to understand and adapt to the digital trade rules of different markets. The Institute recommends that enterprises establish professional digital compliance teams, closely track the digital trade policy dynamics of target markets, and make compliance preparations in advance to ensure that they maintain competitive advantages in an increasingly standardized digital trade environment.
